My Eviction Team provides can assist with your residential or commercial tenant eviction. We start with your intake over the phone and approximately within 24-72* business hours you will receive the eviction notice for review and approval before service by the registered and bonded process server.

Before a landlord can file an unlawful detainer complaint to evict a residential tenant, the tenant must be properly served with an eviction notice, like a 3-day notice to pay rent or quit. If you are thinking about evicting a commercial or retail tenant, the process for eviction is similar to a residential eviction. Landlords still need to serve an eviction notice before filing an unlawful detainer.

Tenant Eviction Process

A lease agreement is signed.

A problem arises- this could be a lease contract violation, unpaid rent, or a Tenant breaking a law.

Landlord and Tenant make an attempt to rectify the situation and resolve the problem. If a solution is not found.. An eviction notice is sent- the Landlord must wait a specific number of days where the Tenant is given time to comply with the notice.

Summons & Complaint is prepared and filed in court. This is when things get serious: the Tenant is served the lawsuit. The Tenant will have 5 days, if personally served, to file an Answer against the lawsuit documents served upon him/her.

Default
  • If the tenant does not file an Answer to the Complaint no court trial required.
  • Request for Entry of Default will be prepared and filed along with the Proof of Service of Summons.

Trial Conducted
      • If tenant Answers Complaint a court trial date is requested and trial date is 15-20 days after trial request.
      • If the Tenant wins, he/she can stay. The Landlord may need to pay the Tenant's court fees and attorney fees.
      • If the Landlord wins, the tenant is ordered to leave. The Judge issues a Court Order, also known as a Judgment for Possession. The Tenant is given an opportunity to leave voluntarily, or will be forcibly removed. The Tenant may need to pay the Landlord based on the Lease Agreement and local laws. These could include court filing fees, attorney fees, unpaid rent, damages and penalties.
